By purchasing any products from this website, you agree to the Terms of Sale appearing in this document. You agree that you are at least 18 years of age or older and you are purchasing with the knowledge that you are abiding by the laws of your state and/or the state in which you are using our products and are bound by the terms and conditions appearing in this document. Failure to do so could result in consequences including but not limited to fines which we will not be held liable for. When your order has left our location and is on its way to you, it is then your responsibility.
Certain products sold on our website are sparklers. Any sparklers purchased from this website come with caution and warning tags with safety instructions that clearly state how and where they should and should not be used. These caution and warning tags are attached directly to the sparklers or on the box the sparklers come in. Sparklers are flammable and may be dangerous to use. Sparklers should not be used by children. By purchasing any sparklers on this website, you agree to use these sparklers at your own risk and to use these sparklers in strict conformance with the manufacturers warnings and instructions contained on the sparklers' packaging. By purchasing sparklers from this website, you agree to fully indemnify Nightlife Supplier Enterprises, Inc. dba Nightlife Supplier from any harm, injury or claim resulting from such use.
We keep inventory of most items that we offer except items that are produced on demand or custom products which have a lead time. Occasionally, we are out of stock of specific items. If this were to occur, we will attempt reach you via phone (at the number you provided on your order) or email (at the email address you provided on your order) to let you know how long we will be out of stock of these items. We might also suggest an alternate comparable product and let you know how long it would take for the original item that you ordered to come back in stock. We will always offer you the option to wait for your original product, substitute your original out-of-stock item with an alternate comparable product or cancel all or part of your order for a full or partial refund.
We do not manufacture any of the products sold on this website, therefore we cannot make any assurances as to their performance or reliability. Any issues relating to this must be resolved through the manufacturer of the products. In addition, all our products are inspected as part of our quality control process however, we cannot control their handling once they have left our location. In the rare occurrence that your product does not work or function the way it should when you receive it, you must notify us via email at orders@nightlifesupplier.com within 14 days of receiving your product. Unfortunately, we will not be able to resolve you issue if you bring it to our attention after 14 days of receiving your order.
We do not accept returns for any sparklers or confetti cannons. All other items may be returned if unopened and in its original condition within 14 days of receiving your order for a full refund less shipping and a 25% restocking fee. You the customer are responsible for all return shipping fees and can use either FedEx or UPS to return your order to us in its original packaging. Please email us the tracking number of your returned shipment to orders@nightlifesupplier.com so we will know when to expect it. You should expect to receive your refund within 21 days of shipping back your package to us, however, in many cases you will receive a refund more quickly. This time period includes the transit time for us to receive your return (3 to 7 business days), the time it takes us to process your return once we receive it (3 to 5 business days), and the time it takes your bank to process our refund request (5 to 7 business days).
If you need to return an item, simply call us at 800-995-2068 so one of our customer service representatives can give you a RMA Number (Return Merchandise Authorization Number). We will notify you via e-mail of your refund once we receive and process your returned item.
We reserve the right to modify or withdraw, temporarily or permanently, the Website (or any part of) with or without notice to you and you confirm that we shall not be liable to you or any third party for any modification to or withdrawal of the Website.
We may alter these terms and conditions from time to time, and your use of the Website (or any part of) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the Conditions have been changed. If you do not agree to any change to the Conditions then you must immediately stop using the Website.
